Cows cause accident

« Back to Blog

Back in December 2007 the claimant in this accident was cycling along a minor road with 3 other friends when they were confronted by cattle on the road. The claimant immediately tried to avoid the cattle and in doing so lost control of his bicycle.

When the claimant fell to the ground he broke his left hand thumb which required pin surgery and his hand was in plaster cast for five weeks. The injury left the claimant unable to work for 12 weeks.

Despite the owner of the cows not being present at the time, he was still liable for the accident, as he had a duty to take reasonable care to prevent the cows from straying or if they did stray to prevent them causing injury or damage.

Actons Solicitors acted on behalf of the claimant and he received £8,000 compensation for his injuries.

If you or a family member suffers an injury as a result of an animal, you may be able to make a claim. There are certain rules for claiming against the owners of animals and we can advise how a claim can be made if these rules are satisfied. It is important that you get independent expert legal advice, preferably as soon as possible.
