Judge rejects toxic sofa claims
More than 300 people who suffered burns after purchasing a sofa from Land of Leather will not receive compensation following a High Court ruling.
The burns were the result of the fungicide called dimethyl fumarate (DMF) which is used to prevent leather going mouldy whilst stored in humid conditions. DMF was used on Linkwise sofas made in China and purchased by Land of Leather.
The insurance company Zurich argued that Land of Leather’s agreement with Linkwise breached terms of its insurance policy and this was upheld by the High Court. This means that Zurich do not have to pay on behalf of Land of Leather. Whilst the affected claimants still have a right of action against Land of Leather, it will not be worth pursuing the company as it was placed in administration in 2009. This means that it is extremely unlikely that the claimants would receive any money even if they were successful.
