Mr S, who was known by his employers to be an epileptic, suffered an epileptic seizure whilst at work and fell onto an unguarded electric fire.  As a result, he suffered very serious burns to his left hand, thigh and groin.

He required two operations for skin grafts, and had to have his thumb, index and middle fingers wholly or partly amputated. He was left with poor functioning of his left hand, and went on to develop depression and anxiety.

We sent a detailed letter of claim to our client’s employer, as a result of which they admitted liability.

Specialist medical evidence was obtained from a consultant orthopaedic and hand surgeon, a consultant psychiatrist and a consultant neurologist.

Our client was unable to return to his previous role and was unsuccessful in obtaining other employment. His future earning capacity was a key issue, so we obtained specialist evidence from an employment consultant to enable us to value his loss of earnings claim.

We acted for him on a No Win No Fee basis. An offer of £175,000 was received, which our client rejected on our advice. He was keen to avoid having to go to court so we arranged a face to face meeting with his employer’s lawyers, to see if the claim could be settled. We were successful in negotiating an award of almost £250,000 as well as payment of our costs by the employer.
