The accident

An 89 year old woman was injured in the sandwich shop, Greggs. She was adding milk to her tea, which was placed on a cupboard, when the door of the cupboard fell off and hit her shin. The lady had not done anything to cause the door to fall.


The injury

She suffered a large cut on her shin, which required her to be seen weekly for 3 months to have the dressings changed to prevent infection.

In addition to this, her social life was affected as she was not able to take part in her usual leisure activities, such as dancing for 3 months. During those 3 months, she had trouble sleeping and suffered from discomfort when walking.

After this period, the injury had resolved but the scarring was permanent.


How we helped claim compensation

Actons work with Age UK Nottingham to offer a free weekly legal advice clinic. Age UK provide support by offering services to elderly members of the public such as an advice line and a befriending service to combat loneliness.

This matter was brought to our attention as part of the legal advice clinic and Actons pursued the claim on the basis that Greggs had failed to exercise the duty of care owed to customers.

The negligence of Greggs caused our clients injury and Greggs accepted fault for this.

In order to secure the highest possible compensation, we arranged for her to see a private doctor for a medical report.

Greggs offered £3000 to settle this matter however, we advised her to reject this offer and secured her a larger sum of £6,500.
