£7,000 compensation secured for girl’s playground injuries

The accident

A 10 year old girl who suffers from autism, was injured at school when the classic playground game British Bulldog was being played by other pupils.

She was not participating and had her back to the game when another student collided with her, causing significant injuries.

The school argued that they were not at fault, as the game was banned and was not being played.

This was contradicted by our client, who stated there were no teachers supervising at the time.

The injury

The child suffered significant injuries to her wrist and face after the fall, including a mouth fracture, a deeply cut lip and bruising.

She had to have a composite filling to repair the fractures in her teeth, but this did not help.

Afterwards, we arranged for her to see a plastic surgeon and private orthodontist for a medical opinion.

It was then advised that she would need surgical treatment, along with a veneer, implant and crown.

How we helped claim compensation

We pursued the claim on the basis that the school, at which the game was banned, had failed to fulfill their duty of care to the children.

Despite the school claiming that the game had not been played, we obtained evidence from witnesses to confirm otherwise.

Throughout the claim process, we ensured that the young girl’s father was up to date with the situation.

£4,000 was offered in full and final settlement from the school but using our knowledge and expertise, we were able to secure a larger sum of £7,000.

This increase was justified as covering the cost of future private dental treatment, with the funds placed in a trust fund for the child, which becomes available at 18.
