I was out hacking with another girl and her horse went to kick my horse and accidentally caught my leg. It has broken my leg, can I claim compensation for my injury?

A: Proving Negligence

It would be difficult here to prove any negligence unless you have a contractual relationship with the other girl.

The Animals Act 1971

In this case, we would have to question whether the horse tends to kick out whenever it’s around others. If so, the owner would have a duty to warn others about coming close to it.
If they had made you aware of this and you decided to bring your horse close to it regardless, you could be accused of endangering yourself. Therefore, you would not be able to claim for this injury.
